Creator Program Terms
Version 2026-10 · Last updated October 15, 2026
This is the agreement between you and Draíocht (a one-person business in Prospect, Virginia) when you join the Draíocht creator program. It’s written to be read, so please read it.
1. Who can join
- You must be at least 18, live in the United States, and be able to receive payments by PayPal, Venmo or Zelle.
- Joining is by application. Draíocht decides who joins and can say no without giving a reason.
2. Your code, link and shop page
- When approved, you get a personal code (like MARIA), a link (draiocht.shop/?ref=MARIA) and a shop page (draiocht.shop/c/maria).
- Shoppers using your code or link get 10% off a one-time order. Subscriptions already save 10%, and the two don’t combine, but subscriptions started with your code still earn you commission.
- A link remembers your code on that shopper’s device for 30 days. If a shopper uses someone else’s code or link later, the order goes to that code. One code per order.
- Your shop page shows the photo and words you submit. We review every change before it goes live and may ask for edits or take a page down.
3. What you earn
- 15% of what the customer pays for the product (after their discount, not counting tax or shipping) on each order placed with your code or link.
- 7.5% of each delivery of a subscription that started with your code, for 6 months from its start.
- Rates can be different for you if we agree in writing (email counts). Any change applies to orders placed after the change.
- No commission on: your own orders, orders to your household or address, orders that are cancelled, refunded or returned, free bottles, or orders we reasonably believe are fraudulent or came from breaking these terms. A partial refund reduces the commission in proportion.
4. When you’re paid
- Commission is “pending” until the order is past our 30-day returns window (30 days after delivery, or 40 days after shipping if delivery isn’t confirmed). It then becomes “approved.”
- We pay approved commission monthly, once you’re owed at least $25, by PayPal, Venmo or Zelle to the account in your creator portal. Smaller amounts carry over.
- You can see your clicks, orders, pending, approved and paid amounts in your creator portal at any time.
5. Taxes
- You’re an independent creator, not an employee, and you’re responsible for your own taxes.
- If your payments in a year reach the IRS reporting threshold, we’ll ask you for a W-9 (privately, never through the website) and send you a 1099-NEC. We may hold payments until we have it.
6. Disclosure (required every time)
- The FTC requires you to disclose your connection to Draíocht whenever you mention it: that you earn a commission, or that you got a free product.
- Make it clear and early, in the content itself: say it out loud in videos and put it on screen or in the first line of a caption. Use “#ad,” “Paid partnership,” “I earn a commission,” or “#gifted” for the free bottle, and turn on the platform’s branded-content or paid-partnership label.
- “#sp,” “#partner,” “thanks Draíocht” or a disclosure hidden in hashtags or behind “more” isn’t enough.
7. What you can and can’t say
- Draíocht is a cosmetic. Talk about how skin looks and feels: hydrated, softer, smoother-looking, comfortable.
- Never say or suggest it treats, heals, cures or prevents any disease or condition (for example eczema, psoriasis, rosacea, keratosis pilaris, acne or wounds), changes the body (“boosts collagen,” “reverses aging”), or works like a drug.
- Only share your honest experience after actually using it. Don’t show edited, filtered or misleading before-and-after results, and don’t claim results you didn’t have.
- Use the facts in the Creator Kit (ingredients, percentages, prices). Don’t invent claims, ratings, awards or “#1” statements.
- Don’t put down other brands or people. Comparisons must be true and current.
8. Where and how you share
- Share on your own channels and with people you know. Don’t post your code on coupon or deal sites, spam, buy followers or clicks, or use bots.
- Don’t run paid search ads on “Draíocht” or close misspellings, and don’t pretend to be Draíocht or its official account.
- Follow each platform’s own rules for branded content and ads.
9. Free bottles
- Approved creators can get one free bottle. You pay only the shipping cost shown in your creator portal (currently $7), by card, when you request it. The bottle itself is free.
- If we can’t send your bottle, we refund the shipping payment in full.
- There’s no obligation to post. If you do post about it, disclose that the bottle was free (#gifted).
- Extra bottles are at our discretion.
10. Using your content
- You own what you create. If you give us permission (in writing, email is fine), we may reshare or boost a specific post with credit to you, for example as a TikTok Spark Ad, for the time you agree to.
- You give us permission to show your shop-page photo, name and statement on your shop page while you’re in the program.
- You can use the Draíocht name, logo and product photos from the Creator Kit only to talk about Draíocht, and not in ways that suggest you are Draíocht.
11. Privacy
- You’ll never see customers’ names, emails or addresses. Your portal shows order dates, amounts and statuses only.
- We keep your application, contact, payout details and a record of your earnings to run the program and for tax records. We don’t sell your information. See our privacy policy.
12. Ending
- You can leave at any time by emailing us. We can pause or end your participation at any time, for example if these terms are broken.
- When you leave, your code and shop page stop working. Approved commission is still paid. Pending commission is paid if the order passes the returns window, unless you left because of a serious breach of these terms (such as fraud or medical claims).
13. Changes and the rest
- We may update these terms. We’ll email you before changes take effect, and continuing in the program means you accept them.
- Nothing here makes you an employee, agent or partner of Draíocht. These terms are governed by the laws of Virginia.
- Questions: draiochthealth@gmail.com.
